1. Who we are
Tender My Listing Pty Ltd (ABN 17 697 239 866; ACN 697 239 866), registered office at 81-83 Campbell Street, Surry Hills NSW 2010, Australia, operates the Platform at tendermylisting.com.au ("we", "us", "our").
This Privacy Policy describes how we handle personal information in compliance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).
2. What information we collect
2.1 Information you provide directly
- Vendors: name, email address, mobile number (for SMS verification), property address, and property details you enter;
- Agents: name, agency name, mobile number, email address, professional credentials, and tender-form responses you submit;
- Communications: any messages you send us via email, support tickets, SMS, or in-app forms.
2.2 Information we compile from public sources
For real estate agents, we also collect publicly available information relating to professional activity, including:
- Name, agency, and photograph as published on real estate listing portals and agency websites;
- Mobile and office phone numbers where publicly displayed;
- Recent sold-property data, average sale prices, and average days on market;
- Suburbs of operation and star ratings from third-party review sites.
This information is used to let vendors discover and invite relevant local agents. See section 7 for how an agent can have this information removed.
2.3 Information we collect automatically
Like most websites, we collect basic technical information when you visit, such as IP address, browser type, pages visited, and referring URL. We use this to operate, secure, and improve the Platform.
3. How we collect it
- Directly from you when you register, submit a tender, or contact us;
- From publicly available sources (for agent profiles only);
- Via cookies and similar technologies when you use the Platform (see section 11);
- From service providers who help us operate the Platform (for example, SMS delivery providers).
4. How and why we use it
We use personal information to:
- Operate the Platform (create accounts, verify mobiles, process tenders);
- Introduce vendors to agents they have chosen to invite;
- Send transactional SMS and email notifications (invitations, tender receipts, reminders, shortlist confirmations);
- Provide customer support and respond to enquiries;
- Ensure the security and integrity of the Platform (including fraud prevention);
- Comply with legal obligations.
5. We do not sell personal information
We do not serve third-party advertising on the Platform. We do not use your data to build advertising audiences or retargeting lists for other companies. Personal data handled by our service providers (for example, SMS delivery partners) is used solely to operate the Platform's functions and is governed by confidentiality obligations.
6. When we disclose information
We only disclose personal information:
- To an agent you shortlist — your name, mobile number, email, and property address are released to the one agent you have chosen to meet, so they can arrange contact. No agent receives your contact details unless and until you shortlist them.
- To service providers who operate parts of the Platform on our behalf (for example, SMS gateway, email delivery, hosting, payment processor). These providers only access data necessary to perform their function and are bound by confidentiality.
- Where required or permitted by law (for example, in response to a valid subpoena or court order).
- In a corporate transaction (for example, business sale), in which case the acquirer inherits the obligations of this policy.
7. Agent profiles sourced from public information
7.1 Why we display public agent information
To help vendors find relevant local agents, we display information about real estate agents that is already publicly available on agency websites, listing portals, and other professional real estate sources. No agent is in a commercial partnership with us or has endorsed our Platform unless expressly stated.
7.2 Agents can remove their profile at any time — free of charge
- Reply REMOVE by SMS from your publicly listed mobile number (processed automatically, usually within seconds);
- Email support@tendermylisting.com.au from an agency email address;
- Log in to your agent account and click "Remove my profile".
Once removed, the agent's profile is hidden from all vendor searches and is no longer available for tender invitations. If an agent wishes to have their details permanently deleted from our systems rather than hidden, they may request this at the email address above and we will delete their personal information, retaining only what is strictly required to satisfy legal or audit obligations.
8. Your removal, access, and correction rights
Under the Australian Privacy Principles, you have the right to:
- Access the personal information we hold about you;
- Correct information that is inaccurate, incomplete, or out of date;
- Request deletion of your personal information (subject to legal retention obligations);
- Opt out of non-transactional communications at any time.
To exercise any of these rights, email support@tendermylisting.com.au. We will respond within 30 days. No fee applies for reasonable requests.
9. Data security
We take reasonable steps to protect personal information against unauthorised access, loss, misuse, or disclosure. Measures include:
- HTTPS encryption for all Platform traffic;
- Password hashing using industry-standard algorithms;
- Access controls limiting staff access to personal information on a need-to-know basis;
- Hosting with reputable infrastructure providers that maintain appropriate security controls.
No online system is perfectly secure. If we become aware of a data breach that is likely to result in serious harm, we will notify affected individuals and the Office of the Australian Information Commissioner (OAIC) in accordance with the Notifiable Data Breaches scheme under the Privacy Act 1988.
10. Data retention
We retain personal information only for as long as reasonably necessary for the purposes it was collected, or as required by law. Typical periods:
- Active vendor accounts: retained while the account is active; deleted on request;
- Completed tender transactions: retained for up to 7 years for tax and audit purposes;
- Agent profiles marked as removed: hidden from all displays; underlying data either anonymised or retained for audit only.
11. Cookies and analytics
We use cookies (small data files stored in your browser) to remember your session, improve site performance, and understand aggregate usage. We use Google Analytics to analyse anonymised traffic patterns. You can disable cookies in your browser settings; some Platform features may not work correctly if you do.
We do not use advertising cookies or behavioural tracking beyond our own site's analytics.
12. Cross-border disclosures
Our Platform is hosted in Australia. Some of our service providers (for example, Google Analytics, SMS gateways) may process data outside Australia, including in the United States or other countries. We take reasonable steps to ensure such providers handle data in a manner consistent with the Australian Privacy Principles, including via data-processing agreements.
13. Complaints
If you believe we have breached the Australian Privacy Principles or otherwise mishandled your personal information:
- Contact us first at support@tendermylisting.com.au. We will acknowledge within 7 days and investigate within 30 days.

14. Updates to this policy
We may update this Privacy Policy from time to time. The updated version takes effect from the "Last updated" date shown above. Where changes are material, we will provide reasonable notice by email or a prominent notice on the Platform.
